I received a letter in the mail today from Verizon Wireless about the 5 GB monthly cap. It states that "Verizon Wireless reserves the right to limit the throughput speed of the service to a maximum of 200 kilobits per second for up to 30 days, without further notice, once 5 gigabytes have been used."

Also it says that "If you are unhappy with these changes, you can cancel your BroadbandAccess service within 60 days of receiving this notice without any early-termination fee."

Has anyone else received this in the mail?

We are updating the Verizon Wireless BroadBandAccess Plans and Features to ensure a great customer experience across our customer based and to maintain fairness to all 65 million people who use our network. This letter is to notify you of the types of significant usage that would cause your wireless broadband speeds to be limited if you do not change to one of our new plans.

We want you to understand these changes. If you are unhappy with these changes, you can cancel your BroadBandAccess service within 60 days of receiving this notice without any early-termination fee.

Dear Customer

Verizon Wireless has expanded the permitted uses of its BroadBandAccess service to include all Internet usage, such as Internet browsing; email; intranet access; uploading, downloading and streaming of audio, video and games; and Voice over Internet Protocol (VOIP). In addition, Verizon Wireless no longer reserves the right to terminate the BroadBandAccess service of customers who use it to send and receive more than 5 gigabytes of data per line in a single monthly billing period. Instead, Verizon Wireless reserves the right to limit the throughput speed of the service to a maximum of 200 kilobits per second for up to 30 days, without further notice, once 5 gigabytes have been used. (As an example, in order to reach 5 gigabytes in a monthly billing period, you would need to send and/or receive approximately 1,747,627 plain text emails, or download approximately 1,280 songs. See further examples on the reverse side of this letter, under "Approximate Data Usage Examples.") If your usage does not exceed 5 gigabytes in a billing period, your service will not be affected. You may assess and monitor your data usage during a particular billing period by accessing My Account online at verizonwireless.com/myaccount or by contacting Customer Service at 1.877.888.7383.

Certain uses, such as uses that are illegal, infringe upon the intellectual property rights of others, directly interfere with other users, interfere with the network's ability to fairly allocate capacity among users or otherwise severely degrade service quality for all users, are still prohibited and are fully described in the new Data Plans and Features terms and conditions on the reverse side of this letter.

Because your data usage has at one time or another exceeded 4 gigabytes in one or more billing periods, and you may be impacted by the speed limitation if you exceed 5 gigabytes in a single billing period in the future, we are allowing you the option of maintaining your service subject to the new policies described above or, if you are unhappy with these changes, canceling your BroadBandAccess service within 60 days of receiving this notice with no early-termination fee. Additionally, under the Worry Free Guarantee, you can change to one of our new plans at any time without having to extend your contract term (see verizonwireless.com/bba).

Data Plans and Features: Permitted Uses. You can use our Data Plans and Features for accessing the Internet and for such uses as: (i) Internet browsing; (ii) email; (iii) intranet access (including accessing corporate intranets, email and individual productivity applications made available by your company); (iv) uploading, downloading and streaming of audio, video and games; and (v) Voice over Internet Protocol (VOIP).

Data Plans and Features: Prohibited Uses. You may not use our Data Plans and Features for illegal purposes or purposes that infringe upon others' intellectual property rights, or in a manner that interferes with other users' service, interferes with the network's ability to fairly allocate capacity among users or that otherwise degrades service quality for other users. Examples of prohibited usage includes: (i) server devices or host computer applications that are broadcast to multiple servers or recipients such that they could enable "bots" or similar routines (as set forth in more detail in (iii) below) or otherwise denigrate network capacity of functionality; (ii) as a substitute or backup for private lines or dedicated data connections; (iii) "auto responders," "cancel bots," or similar automated or manual routines that generate amounts of net traffic that could disrupt net user groups or email use by others; (iv) generating "spam" or unsolicited commercial or bulk email (or activities that facilitate the dissemination of such email_; (v) any activity that adversely affects the ability of other users or systems to use either Verizon Wireless' services of the Internet-based resources of others, including the generation or dissemination of viruses, malware or "denial of service" attacks; (vi) accessing, or attempting to access without authority, the information, accounts or devices of others, or to penetrate, or attempt to penetrate, Verizon Wireless' of another entity's network or systems; or (vii) running software or other devices that maintain continuous active Internet connections when a computer's connection would otherwise be idle, or "keep alive" functions, unless they adhere to Verizon Wireless' requirements for such usage, which may be changed from time to time. By way of example only, you may not use a Data Plan or Feature for Web broadcasting, or for the operation of servers, telemetry devices and/or Supervisory Control and Data Acquisition devices.

If your usage on a Data Plan or Feature that does not include a specific monthly megabyte allowance or that is not billed on a pay-as-you-use basis exceeds 5 gigabytes per account line during any billing period, we reserve the right to reduce the throughput speed to a maximum of approximately 200 kilobits per second for up to 30days. You may assess and monitor your own data usage during a particular billing period, including the Return Period under your Worry Free Guarantee, by accessing My Account online or by contacting Customer Service.

Approximate Data Usage Examples:
Basic information and examples showing approximate data usage for several common Internet activities appear below.

The speed of the Verizon Wireless data network is measured in kilobits (Kb) per second. However, the amount of data transmitted over the Verizon Wireless data network is measured in kilobytes (KB), megabytes (MB) or gigabytes (GB).

  • Bit: A unit of information that represents a single character.
  • Byte: A unit of information composed of 8 bits
  • Kilobyte: 1,024 bytes (measuring the number of kilobytes tells you the size of a file and/or the amount of data you have used)
  • Megabyte: 1,024 kilobytes (measuring the number of megabytes tells you the size of a file and/or the amount of data you have used)
  • Gigabyte: 1,024 megabytes (measuring the number of gigabytes tells you the size of a file and/or the amount of data you have used)


Examples
Approx. Size -- Application -- Description
  • 3KB -- Email (1 text page without attachments) -- Based on this assumption, you would need to send or receive approximately 1,727,627 emails in a month to reach 5GB.
  • 70KB -- Word Document (5 text pages) -- Based on this assumption, you would need to download approximately 74,897 Word documents in a month to reach 5GB.
  • 150KB -- Typical Web Page Lookup -- Based on this assumption, you would need to lookup approximately 34,952 Web pages in a month to reach 5GB.
  • 500KB -- Low Resolution Digital Photo -- Based on this assumption, you would need to download approximately 10,486 low-resolution digital photos in a month to reach 5GB.
  • 3MB -- PowerPoint Presentation (20 text pages & light graphics) -- Based on this assumption, you would need to download approximately 1,707 PowerPoint presentations in a month to reach 5GB.
  • 2MB -- V CAST Music Over-the-Air Download (3 minute song) -- Based on this assumption, you would need to download approximately 2,560 songs in a month to reach 5GB.
  • 4MB -- V CAST Music PC Download (3 minute song) -- Based on this assumption, you would need to download approximately 1,280 songs in a month to reach 5GB.


Note: The above examples are just estimates, based on approximate size assumptions. Actual file sizes and user experiences will vary.

We further reserve the right to take measures to protect our network and other users from harm, compromised capacity or degradation in performance. These measures may impact your service, and we reserve the right to deny, modify or terminate service, with or without notice, to anyone we believe is using Data Plans or Features in a manner which adversely impacts our network.

Did you sign up when it was still being advertised as "Unlimited"?

If you're not sure, just post the approx. date you signed up. I think that October or November 2007 was the cut-off.

I've had the account since September 2007 so I would guess it would be the first or second TOS. On the Verizon Wireless website it has unlimited under allowance for the account.

I did not get this letter, but I don't need my verizon EVDO anymore. Can I still call verizon and cancel my service without paying ETF?

I believe if your usage exceeded or was close 5gb, you would receive the letter. Otherwise, Verizon would leave you alone.

We often use at least 7-8GB per month and haven't heard anything from Verizon. We live in a rural area, though.

Well it's an easy fix IF you have Sprint coverage in your area. I canceled without ETF's and glad I did. I went with Sprint who has NO cap and ya gotta love the speeds LOL!!! Actually 3G handled it all for me and see what i got lol!?


Never saw this with my Verizon account!!......

Man I just don't know. I was shocked and posted in another forum about it (the speeds). I mean it is consistent as all get out too! I know one thing. This RV Park must be right under the tower AND I'm not moving lol!

Good Morning!!! New guy here from Texas!!!!

I have been reading your forums for the last 2 weeks trying to find a good solution for my mom who lives about 7 miles outside of any cable runs..DSL etc... so cellular was the way to go...

Talking about the 5gb cap.. AT&T, who I nded up getting the setup with, has a 5gb cap on the plan, they do not advertise unlimited in any of the promotions. They don't say anything about additional fees if exceeded but I'm sure it is one of those reduce your bandwidth things as well... Hughes Net was like that when I first started using it back in like 1998 or so when it was only offered on the download side but you had to have dialup for the upload.

The third paragraph following the "Dear Customer" it states "because your usage has exceeded 4 gb", maybe this is why some get the letter and some don't.
