I'm afraid I am one of the 1%'ers. Starting mon sprint has been ringing my phone off the hook trying to reach me. Received a letter yesterday saying they would like to speak to me regarding a change in TOS on my data card please call before Aug 16.
Well I called today and talked to a very nice lady named Tina. I played completely dumb in wondering what they wanted to talk to me about.
She very politely wanted to let me know about the 5 gb cap and the 300mb roaming thing and that I had till Aug 16 to cancel w/o the ETF if I didn't think I could obey the 5gb law. I asked if I could be on month to month and she said, "Oh no. We cannot do that". ok fine i'll call retention later, maybe. I then asked if there would be any monetary penalty for going over like 3 cents per kb for example and she said "definitely not".
A little back story at this point. Last Jan and Feb I had more than 60gb for each month and last month was 41gb. This month I am at 12gb with the month starting a week ago.
Tina said everybody is going to be contacted eventually so I think they are starting with the 1 percent and going down from there. The phone number I called is a direct line to these people and there are alot of them maning the phones for this purpose of official notification.
At the end of the conversation she mentioned the fact that sprint reserves the right to "terminate without prejudice" (my words) anyone who violates the 300mb roaming or 5 gb 2 months in a row in a 3 month period. Meaning you are going to get hit with the ETF. I asked her if this month counted as the 5gb term (since i am at 12gb) and she said no because i wasn't officially notified until today so mine will start on Aug 17. She mentioned that I could quit before Aug 16 w/o ETF 3 times during our talk.
So it looks like you can be bad one month, good the next and then bad again and then good again, and so on. As long as you don't have 2 overage months in a row. Tina said they will notify you in plenty of time if you are going to be in danger. email, phone call etc. Looks like they are going to do heavy watching.
There you have it. If Michael oks it I can post the direct phone number here so if you want to call you can. At least fernizzle will be able to get some sleep.

| If its the case where you can use more than 5gb every other month then, I may not be so disappointed with Sprint. |

2 out of three months. So if you alternate months, your going to get flagged. I'm guessing if you're using 60 gigs on any given month, they are going to come down on you. |

Otherwise, it would have made no sense to mention 3 month period at all.
If that is the case 5gig-5gig-ulimited-5gig-5gig-unlimited will need to be the pattern. _________________ Vista64 & EX720 |

Yes ebiz your pattern would be the safest as you wouldn't have to guess where the 3 months starts. I asked her if I could do the 5gb-unl-5gb-unl and she said yes as long as I didn't exceed the 5gb cap 2 consecutive months or two months in a row. She was very careful to explain that. So both would work as long as you don't do 5gb-unl-unl-5gb-5gb

I can deal with that. I hope. But I really don't think I'll ever use 60gb in one month anyway. More like 25gb - 30gb max if I go crazy. |

If what you're saying is true (that is, it's actually Sprint policy, not that the rep said it. I believe the rep said it) -- then it sounds like you high-usage folks can get unlimited for $120/mo by just signing up for two data cards. Use one for a month, then alternate with the other one.
Until Sprint changes their terms again, sticking you with two accounts with potential ETFs.  |

each card would still be limited. You'd have to alternate 3 cards for that formula to work.
Also I suspect that what Sprint means by "going over" one out of three months they are thinking more along the lines of a few gigabytes. I'm betting if you use 20 or more gigs in one month they are going to come down on you regardless of your usage the previous months. |
